2 · Nature of the service

3 · Your account

An account is associated with a unique email address. You are responsible for maintaining the confidentiality of access to your inbox (the magic link is sent there). Wingchum will never ask for your password · there is none.

4 · Acceptable use

The service is intended for Canadian private pilots to keep their flight log, consult aviation fuel prices and use the aeronautical directory. You agree not to · distribute unlawful content, attempt to access other users' accounts, scrape or mass-collect data, compromise the infrastructure.

5 · Intellectual property

The Wingchum source code is published under the MIT license (github.com/wingchum-aero). The content you submit (flight log entries, notes) remains your property. By storing it on Wingchum, you grant a limited, non-exclusive license to the service to store, back up and return it to you.

6 · Flight log and CARs 401.08 compliance

Wingchum facilitates keeping a flight log compliant with the Canadian Aviation Regulations (CARs 401.08). Responsibility for the accuracy of submitted information (flight time, registration, conditions) lies with the pilot, in accordance with Transport Canada regulatory obligations.

7 · Limitation of liability

Wingchum shall not be held liable for the consequences of an error in your flight log, service unavailability, or data loss. To the extent permitted by Quebec law, Wingchum's liability is capped at the amount paid for the service over the last 12 months (currently zero, the beta being free).

8 · Termination

You may delete your account at any time from your profile · deletion is final and leads to erasure of your data within 30 days (Loi 25 art. 35). Wingchum may suspend or delete an account for use contrary to these terms, after prior notice except in case of manifest abuse.

9 · Applicable law and jurisdiction

These terms are governed by the laws of Quebec and Canada. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the Montreal judicial district.

10 · Changes to terms

Any material change to these terms will be notified by email at least 14 days before it takes effect. Continued use after that date constitutes acceptance.
